Terms of Use

These terms govern the use of the Mgaguli Tutoring learning portal by enrolled students. Please read them carefully.

1. Acceptance of These Terms

These Terms of Use govern access to and use of the Mgaguli Tutoring learning portal. By logging in to the portal, you agree to be bound by these terms. If you do not agree to these terms, you must not use the portal.

These terms apply together with the Privacy Policy, which explains how your personal information is handled.

2. Eligibility and Accounts

The portal is a private platform reserved for enrolled Mgaguli Tutoring students. Accounts are created by the tutor only. There is no public registration, and access by anyone who is not an enrolled student is prohibited.

Your account gives you access to the courses in which you are enrolled, for the duration of your active enrollment. Enrollment and payment arrangements are made directly with the tutor outside the platform.

3. Account Security

Your account is strictly personal. You must keep your password confidential and must not allow any other person to use your account.

You are responsible for activity that occurs under your account. If you suspect that your account has been accessed by someone else, you must notify the tutor immediately so the account can be secured. Passwords can be reset from the login page or with the tutor's assistance.

4. Course Content and Intellectual Property

All course materials on the portal, including lesson videos, notes, slides, code examples, and downloadable resources, are the intellectual property of Mgaguli Tutoring and are protected by copyright.

Your enrollment grants you a personal, non-transferable licence to use these materials for your own study only. You may not share, publish, re-upload, resell, or otherwise redistribute any course material. This prohibition includes sharing video links, downloaded files, or login access with any person who is not enrolled in the relevant course.

Unauthorised distribution of course material is treated as a serious breach of these terms and will result in the suspension or termination of access.

5. Student Submissions

Work that you submit for tasks remains your own. By submitting work, you grant the tutor permission to review, assess, and provide feedback on it as part of the tutoring service.

All submitted work must be your own. Submitting work produced by another person undermines the purpose of tutoring and may result in feedback and marks that do not reflect your actual progress.

6. Acceptable Use

You must not attempt to: access another student's account, submissions, feedback, or records; access courses in which you are not enrolled; circumvent any access control or security measure; or interfere with, overload, or disrupt the operation of the portal.

Violations of this section are treated as serious misconduct and will result in immediate suspension of access.

7. Service Availability

The portal is an actively developed platform and is provided on an as-is basis. Reasonable efforts are made to keep the service available and reliable, but uninterrupted availability is not guaranteed. Features may be added, changed, or removed as the platform develops.

Material updates that affect students are communicated on WhatsApp. If the portal is temporarily unavailable, tutoring continues through the ordinary channels and the tutor remains reachable on WhatsApp.

8. Suspension and Termination

Access to the portal ends when your enrollment ends, expires, or is suspended, or when these terms are breached.

Mgaguli Tutoring reserves the right to suspend or terminate any account that is used in breach of these terms. Following termination, your records are handled in accordance with the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by South African law, Mgaguli Tutoring shall not be liable for any indirect or consequential loss arising from the use of, or inability to use, the portal. Nothing in these terms limits any liability that cannot lawfully be excluded.

10. Governing Law

These terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.

11. Changes to These Terms

These terms may be updated from time to time. Material changes will be communicated to students on WhatsApp before they take effect, and the effective date below will be updated accordingly. Continued use of the portal after a change takes effect constitutes acceptance of the updated terms.
